Terms of use of the Maker Core online store

These Terms govern the conclusion and performance of sales contracts through the Maker Core online store (the "Store"), available at makercore.pl and the brand's other domains, operated by Aperto Spółka z ograniczoną odpowiedzialnością (brand: Maker Core) with its registered office in Warsaw (ul. Grzybowska 87, 00-844), tax ID (NIP) 5272692210, statistical number (REGON) 146623535, entered in the register of entrepreneurs of the National Court Register (KRS) under number 0000444048 (the "Seller").
Before placing an order, the Customer must review the Terms. During checkout the Customer confirms knowledge and acceptance of the Terms and the Privacy Policy. The Terms remain permanently available in the Store in a form that allows them to be retrieved, reproduced and saved.
Buyers who are consumers enjoy the protection granted to consumers under Polish and European Union law. A natural person running a business has consumer status if the purchase is not of a professional nature for them, resulting in particular from the subject of their business activity (Consumer Rights Act). Other Customers (companies, institutions) conclude the contract on the terms of these Terms and the Polish Civil Code.
Orders can be placed 24 hours a day, 7 days a week, all year round.
The sales contract is concluded in the following sequence:
Product information presented in the Store (including technical parameters, photos and documentation) is not an offer within the meaning of the Civil Code, but an invitation to submit offers. The product page is the binding description of the goods ordered.
The Store offers a free Customer account. The account allows placing orders without re-entering details, access to order and invoice history, and address management. The Customer is obliged to provide truthful data and to protect their login credentials from disclosure to third parties.
The account can be deleted at any time — by email to hello@makercore.pl or via the account-deletion function, if available. Deleting the account does not affect sales contracts concluded before its deletion.
The newsletter is a separate service: subscription requires separate consent (the form on the site), and every message contains an unsubscribe link.
Prices are expressed in the currency linked to the delivery region (Polish złoty, euro, Czech koruna) and include VAT and other applicable taxes. The unit price is given on each Product page.
The Customer is obliged to pay the price plus delivery cost when placing the order (online payment) or — for a traditional bank transfer — within the deadline stated in the order summary (as a rule 3 business days; after that, the order may be cancelled if no payment has arrived).
Available payment methods:
Availability of individual methods may depend on the delivery region and is visible in the cart before the order is confirmed. Online payment confirmation happens automatically after authorisation.
The purchase invoice (electronic) is attached to the shipment or sent to the email address given in the order. The Customer may request a business invoice with a VAT number — the invoicing field at checkout serves this purpose.
Price reductions. For products marked as discounted we display the lowest price of that product from the 30 days before the reduction (the Omnibus disclosure duty). The full price history is available on the product page.
The Store delivers within Poland and other European Union countries for which a delivery region is available. Available destinations and delivery methods (courier, pickup points) are visible in the cart when placing the order.
Orders are handed to the carrier promptly, as a rule within 24 hours of payment confirmation (business days). Delivery time depends on the chosen method and destination and is shown in the order summary. The fulfilment period runs from payment confirmation, or — for bank transfers — from receipt of the payment.
A proof of purchase is included with the shipment. The delivery cost is shown before the order is confirmed; if the carrier cannot deliver on the first attempt, re-delivery information is handled by the carrier under its own procedures.
The risk of accidental loss or damage passes to the Customer who is a consumer upon handover of the goods to the carrier. The Customer should inspect the shipment in the presence of the courier — if the outer packaging is damaged, a damage report should be drawn up.
A Customer who is a consumer (or quasi-consumer entrepreneur) may withdraw from the sales contract within 14 days without giving a reason. The period runs from the day the Customer or a third party indicated by them takes possession of the Product (for multiple shipments — from taking possession of the last one).
Withdrawal is made by submitting a statement — an email to hello@makercore.pl or a letter to the Seller's registered office is sufficient. The model withdrawal form (annex to the Terms) may be used but is not mandatory. We acknowledge receipt of the statement on a durable medium without delay.
The right of withdrawal does not apply, among others, to:
Within 14 days of receiving the withdrawal statement the Seller refunds all payments received from the Customer, including delivery costs corresponding to the cheapest delivery method available in the Store. The refund may be withheld until the Product is received or proof of return shipment is provided. The Customer returns the Product promptly, no later than 14 days from withdrawal, to the address indicated by the Seller (given in the withdrawal acknowledgement); the Customer bears the return shipping cost.
The Customer is liable for any diminution in the value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning. Inspecting the Product — even after unboxing — is permissible to the extent the Customer would have done in a physical store (checking compliance with the description and completeness).
Businesses (other than quasi-consumer entrepreneurs) have no right of withdrawal from a distance contract — returns by companies are agreed individually.
The Seller is liable for non-conformity of the Product with the contract existing at the time of delivery and revealed within 2 years, under the Polish Civil Code provisions on conformity of goods with the contract (as applicable to consumers). It is presumed that a non-conformity revealed within 2 years of delivery existed at the time of delivery, unless proven otherwise or the presumption cannot be reconciled with the nature of the Product.
A complaint may be filed:
The complaint should describe the non-conformity, the date it was revealed, the Customer's demand (repair, replacement, price reduction or withdrawal from the contract) and details identifying the purchase (order number, proof of purchase). Photos and technical documentation speed up the process but are not a condition of accepting the complaint.
The Seller responds to the complaint within 14 days of receipt. If no response is given within that period, the complaint is deemed accepted. If a returned item needs to be transported to assess the complaint, the Seller covers the transport cost.
If the Product is non-conforming, the consumer may demand repair or replacement; for a significant non-conformity, a price reduction or withdrawal from the contract, in line with the Civil Code.
Under the statutory warranty (Art. 556 et seq. of the Polish Civil Code) the Seller is liable for physical and legal defects of the Product. Complaints are filed as above; the Seller responds within 14 days. A non-consumer Customer loses warranty rights if they failed to inspect the Product within the customary time and did not promptly notify the Seller of the defect.
Some Products are covered by the manufacturer's warranty — details (period, scope, procedure) are in the documentation attached to the Product or on its page. The manufacturer's warranty neither limits nor excludes the consumer's statutory warranty rights.
The Seller is the controller of Customers' personal data. Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the Polish data-protection act — for the purposes and on the bases described in the Privacy Policy.
The Seller reserves the right to amend the Terms for material reasons (changes in law, sales organisation, payment methods). We inform about changes in the Store at least 7 days in advance, publishing the amended text and its effective date. Orders placed before the changes take effect are fulfilled under the Terms in force when the order was placed.
The sales contract is concluded in Polish (for international domains — in the domain's language), for an indefinite term, at the moment of conclusion. Upon concluding the contract the Customer has no obligation other than to pay the price.
Out-of-court dispute resolution. Consumers may use out-of-court methods of handling complaints and pursuing claims, including through the permanent amicable consumer court at the Trade Inspection (Inspekcja Handlowa). Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.
The Store's name, logo and content are legally protected; using them without the Seller's consent is prohibited. Copying manufacturers' technical parameters and documentation beyond permitted personal use is prohibited.
For matters not governed by these Terms, Polish law applies, in particular the Civil Code, the Consumer Rights Act, the Act on Providing Services by Electronic Means and the Copyright and Related Rights Act. In case of differences between language versions of the Terms, the Polish version prevails.
The court competent for disputes with a consumer is determined under general rules; a consumer may additionally — within the limits permitted by law — use an amicable court.
